Términos y Condiciones de Uso – AI-Workout-PRO

1. Identificación del servicio
AI-Workout-PRO es una aplicación de acondicionamiento físico asistido por inteligencia artificial, operada mediante método hibrido; algoritmos y prompts desarrollados por Agentes Inteligentes, con domicilio en Costa Rica y correo electrónico de contacto: soporte@agentesinteligentes.org.

2. Naturaleza del servicio
La Aplicación tiene como finalidad proporcionar rutinas de ejercicio personalizadas con fines de acondicionamiento físico general.
AI-Workout-PRO no ofrece servicios médicos, diagnósticos clínicos, tratamientos ni asesoramiento médico profesional.

3. Uso bajo responsabilidad del usuario
El usuario declara que la información proporcionada es veraz y reconoce que la práctica de actividad física implica riesgos inherentes.
El uso de la Aplicación se realiza bajo la exclusiva responsabilidad del usuario.

4. Limitación de responsabilidad
Agentes Inteligentes no será responsable por lesiones físicas, daños, accidentes o consecuencias derivadas directa o indirectamente del uso de las rutinas sugeridas por la Aplicación, incluyendo condiciones de salud preexistentes no informadas por el usuario.

5. Inteligencia artificial
El usuario reconoce que las recomendaciones de entrenamiento son generadas mediante sistemas automatizados de inteligencia artificial, los cuales pueden contener errores o imprecisiones.
No se garantiza ningún resultado específico en términos de rendimiento físico o salud.

6. Propiedad intelectual
Todos los contenidos de la Aplicación, incluyendo textos, rutinas, prompts, algoritmos, diseños, marcas, logotipos y software, son propiedad exclusiva de Agentes Inteligentes o cuentan con las licencias correspondientes. Queda prohibido su uso no autorizado.

7. Protección de datos personales
El tratamiento de los datos personales del usuario se rige por la Política de Privacidad de AI-Workout-PRO, la cual forma parte integral de estos Términos y Condiciones.

8. Uso por menores de edad y Responsabilidad Parental

8.1. Restricción de Edad: La Aplicación está diseñada para personas mayores de 18 años. El uso por parte de menores de edad está estrictamente condicionado a la supervisión directa y constante de sus padres, tutores o representantes legales.

8.2. Consentimiento y Supervisión: Al permitir que un menor de edad bajo su cargo acceda a la Aplicación, el padre, madre o representante legal manifiesta su consentimiento expreso y asume de forma plena y exclusiva la Responsabilidad Parental por dicho uso. Esto incluye, pero no se limita a:

• La veracidad de los datos de salud ingresados por o para el menor.

• La idoneidad física del menor para realizar las rutinas sugeridas por la IA.

• La supervisión técnica durante la ejecución de cada ejercicio para evitar lesiones.

8.3. Exoneración por Daños: Los representantes legales aceptan que el desarrollador no tiene capacidad de verificar la edad real ni la condición física del usuario en tiempo real. En consecuencia, los padres o tutores legales exoneran al desarrollador de toda responsabilidad civil o penal por cualquier lesión, daño o afectación a la salud física o mental del menor, derivada del uso de la Aplicación, reconociendo que cualquier omisión en la vigilancia del menor es responsabilidad exclusiva del adulto encargado.

8.4. Capacidad Legal: El uso de la Aplicación por un menor sin el debido consentimiento se considerará una violación a estos Términos y Condiciones, facultando al desarrollador para la cancelación inmediata de la cuenta sin responsabilidad alguna.

9. Modificaciones
Agentes Inteligentes se reserva el derecho de modificar estos Términos y Condiciones en cualquier momento.
El uso continuado de la Aplicación implica la aceptación de dichas modificaciones.

10. Legislación aplicable y jurisdicción
Estos Términos y Condiciones se rigen por las leyes de la República de Costa Rica. Para cualquier controversia, las partes se someten a la jurisdicción de los tribunales competentes de Costa Rica, sin perjuicio de los derechos del consumidor reconocidos en otras jurisdicciones.

11. Aceptación
El acceso y uso de AI-Workout-PRO implica la aceptación expresa de los presentes Términos y Condiciones.

Terms and Conditions of Use – AI-Workout-PRO

1. Service Identification

AI-Workout-PRO is an AI-assisted fitness application, operated using a hybrid method; algorithms and prompts developed by Agentes Inteligentes, located in Costa Rica and with the following contact email: soporte@agentesinteligentes.org.

2. Nature of the service
The Application is intended to provide personalized workout routines for general fitness purposes.
AI-Workout-PRO does not provide medical services, clinical diagnoses, treatments, or professional medical advice.

3. Use under the user’s responsibility
The user declares that the information provided is truthful and acknowledges that physical activity involves inherent risks.
Use of the Application is carried out under the sole responsibility of the user.

4. Limitation of liability
Agentes Inteligentes shall not be liable for physical injuries, damages, accidents, or consequences arising directly or indirectly from the use of the routines suggested by the Application, including pre-existing health conditions not disclosed by the user.

5. Artificial intelligence
The user acknowledges that training recommendations are generated by automated artificial intelligence systems, which may contain errors or inaccuracies.
No specific results are guaranteed in terms of physical performance or health.

6. Intellectual Property

All content in the Application, including text, routines, prompts, algorithms, designs, trademarks, logos, and software, is the exclusive property of Agentes Inteligentes or is licensed under the corresponding licenses. Unauthorized use is prohibited.

7. Personal data protection
The processing of the user’s personal data is governed by the AI-Workout-PRO Privacy Policy, which forms an integral part of these Terms and Conditions.

8. Use by Minors and Parental Responsibility

8.1. Age Restriction: The Application is designed for individuals over 18 years of age. Use by minors is strictly conditioned upon the direct and constant supervision of their parents, guardians, or legal representatives.

8.2. Consent and Supervision: By allowing a minor under their care to access the Application, the parent or legal representative expressly consents to and assumes full and exclusive Parental Responsibility for such use. This includes, but is not limited to:

• The accuracy of the health data entered by or for the minor.

• The minor's physical fitness to perform the routines suggested by the AI.

• Technical supervision during the execution of each exercise to prevent injuries.

8.3. Disclaimer of Liability: Legal representatives acknowledge that the developer has no ability to verify the user's actual age or physical condition in real time. Consequently, parents or legal guardians release the developer from all civil or criminal liability for any injury, damage, or harm to the minor's physical or mental health arising from the use of the Application, acknowledging that any failure to supervise the minor is the sole responsibility of the adult in charge.

8.4. Legal Capacity: The use of the Application by a minor without proper consent will be considered a violation of these Terms and Conditions, entitling the developer to immediately terminate the account without any liability.

9. Modifications
Agentes Inteligentes reserves the right to modify these Terms and Conditions at any time.
Continued use of the Application implies acceptance of such modifications.

10. Governing law and jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Costa Rica. For any dispute, the parties submit to the jurisdiction of the competent courts of Costa Rica, without prejudice to consumer rights recognized in other jurisdictions.

11. Acceptance
Access to and use of AI-Workout-PRO implies the user’s express acceptance of these Terms and Conditions.
